It is one of the most straightforward ways to immigrate to the United States. However, that is not to say that it is always easy. There are a lot of issues that can arise during a spousal visa application. For many couples, the interview is especially stressful. Though, with proper preparation, it does not have to be. Tip #1: Understand the Legal Standard: The Government Is Testing for a Bona Fide Marriage

A spousal immigrant visa under INA § 201(b)(2)(A)(i) requires proof of a bona fide marital relationship. The consular officer is not assessing romance. The officer is determining whether the marriage was entered into for legitimate marital purposes rather than to evade immigration law. The legal inquiry focuses on intent at the time of marriage, shared life evidence, and credibility. 

Practical Takeaway: You should review your entire petition package before the interview and make sure your answers match what was filed.

Tip #2: Prepare Detailed Biographic and Relationship Information

The interview is testimonial evidence. The officer may ask specific questions about daily routines, living arrangements, employment, prior marriages, children, financial integration, and how the couple met. The goal is to assess credibility through detail and consistency. Officers compare answers to documentary evidence already in the file. Inconsistencies can raise red flags.

Practical Takeaway: You should practice answering questions clearly and truthfully. However, you should not attempt to memorize a script. Prepare, but keep it natural.

Tip #3: Address Issues of Inadmissibility Before the Interview 

A spousal visa applicant must be admissible to the United States. Grounds of inadmissibility include unlawful presence, prior removal, criminal convictions, fraud, and certain health-related findings. Some grounds require filing Form I-601 or I-601A for a waiver. Others may bar admission without waiver eligibility. 

Practical Takeaway: The best approach is to conduct a full admissibility review before the interview, especially if there were prior visa issues.

Tip #4: Organize and Update All Supporting Documentation

Even if the petition was approved by USCIS, the consular officer independently evaluates the case. Updated financial evidence, proof of ongoing relationship, recent photographs, joint accounts, lease agreements, and communication records strengthen credibility. Financial sponsorship must meet statutory requirements under INA § 213A through a properly completed Form I-864 Affidavit of Support. 

Practical Takeaway: Organization is key. You and your spouse should bring updated financial and relationship evidence, even if you already submitted documents to USCIS.
